Another Victory for Minces Rankin PLLC
July 26th, 2021 by David Minces
The lawyers at Minces Rankin PLLC recently secured another major victory for their client.
In a high-stakes commercial dispute over a contract, Minces Rankin PLLC represented an individual respondent-counterclaimant before a Panel of three AAA Arbitrators in Atlanta, Georgia. The firm’s client was sued by a wealthy business owner who may have learned a lesson about making false allegations and trying to intimidate good people.
Over a period of four years, Minces Rankin’s client was sued twice by the same person and his companies. Each time, the bad actors asserted nine different claims against Minces Rankin’s client – including claims for breach of contract, fraud, conversion, misappropriation, and unjust enrichment. In each case, the bad actors sought more than $4.5 million from Minces Rankin’s client, including punitive damages.
After a full arbitration hearing on the merits and post-hearing briefing, all claims against Minces Rankin PLLC’s client were tossed out. In addition, Minces Rankin PLLC’s client prevailed on all three of his counterclaims – including breach of contract, fraud and unjust enrichment – against two companies and the individual owner of that company.
In the final award, the panel of arbitrators unanimously awarded Minces Rankin PLLC’s client more than $500,000 and held all three of the opposing parties (i.e., the wealthy businessman and his companies) jointly and severally liable for the full amount of the award.
